1. Introduction
These Terms and Conditions (“Terms”) govern your purchase of products and services from Hansen Flooring Limited (Company Number XXXXXX) (“Hansen Flooring”, “we”, “us”, “our”). By placing an order with us, you agree to be bound by these Terms.

2. Definitions
- “Products” means the flooring products, samples, and accessories supplied by Hansen Flooring
- “Services” means any services provided by Hansen Flooring, including consultation and design services
- “Order” means your request to purchase Products from us
- “Contract” means the agreement between you and Hansen Flooring for the supply of Products
- “Consumer” means an individual purchasing Products for personal, domestic, or household use
- “Trade Customer” means a business purchasing Products for commercial purposes
3. Orders and Acceptance
3.1 Placing an Order
Orders can be placed via our website, by phone, by email, or in person at our showroom. All orders are subject to acceptance and availability.
3.2 Order Acceptance
An order is not accepted until we provide written confirmation (including email). We reserve the right to refuse any order at our discretion. Upon acceptance, a binding Contract is formed between you and Hansen Flooring.
3.3 Order Accuracy
You are responsible for ensuring the accuracy of your order, including product specifications, quantities, and delivery details. We recommend reviewing all information carefully before confirming your order.
3.4 Quotations
Quotations are valid for 30 days unless otherwise stated. Prices are subject to change without notice until an order is accepted. Quoted prices do not include GST unless expressly stated.
4. Pricing and Payment
4.1 Prices
All prices are in New Zealand Dollars (NZD) and exclude GST unless otherwise stated. Prices are subject to change without notice. The price applicable to your order will be the price confirmed at the time of order acceptance.
4.2 Payment Terms
- Retail Customers: Full payment is required prior to dispatch of Products
- Trade Customers: Payment terms as agreed in your trade account application (typically 20th of month following invoice)
- Custom Orders: 50% deposit required at order confirmation, balance due prior to dispatch
4.3 Payment Methods
We accept the following payment methods:
- Bank transfer (direct credit)
- Credit card (Visa, Mastercard)
- EFTPOS (in showroom)
- Trade account (approved customers only)
4.4 Late Payment
If payment is not received by the due date, we reserve the right to charge interest at 2% per month on the outstanding amount. We may also suspend further deliveries until payment is received.
5. Delivery
5.1 Delivery Options
- Standard Delivery: To your nominated address within New Zealand
- Showroom Collection: Available from our Clevedon showroom
- Third-Party Freight: For remote locations or large orders
5.2 Delivery Times
Delivery times are estimates only and are not guaranteed. While we make every effort to meet estimated delivery dates, we are not liable for delays caused by factors beyond our control, including freight delays, customs clearance, or stock availability.
5.3 Delivery Charges
Delivery charges are calculated based on order size, weight, and destination. Charges will be confirmed at the time of quotation or checkout. Free delivery may be available for orders over certain thresholds within specific areas.
5.4 Risk and Title
Risk in the Products passes to you upon delivery. Title (ownership) remains with Hansen Flooring until full payment has been received.
5.5 Inspection on Delivery
You must inspect Products upon delivery and report any damage or discrepancies within 48 hours. Failure to report issues within this timeframe may affect your ability to claim.
6. Returns and Refunds
6.1 Consumer Rights
If you are a Consumer, you have rights under the Consumer Guarantees Act 1993. These Terms do not exclude, restrict, or modify these rights.
6.2 Returns Policy
Standard stock products in original, unopened condition may be returned within 14 days of delivery for a refund, less a 20% restocking fee. Returns must be pre-approved by Hansen Flooring.
6.3 Non-Returnable Items
The following items cannot be returned:
- Custom-made or special order products
- Cut-to-size products
- Products that have been installed
- Products not in original condition
- Sample products (unless defective)
6.4 Defective Products
If Products are defective upon delivery, please contact us immediately. We will arrange inspection and, where appropriate, repair, replacement, or refund in accordance with your legal rights.
6.5 Return Shipping
Return shipping costs are the responsibility of the customer unless the return is due to our error or a product defect.
7. Product Information
7.1 Natural Variations
Timber and engineered flooring products are natural materials and will exhibit variations in colour, grain, and texture. These variations are not defects and are part of the natural beauty of the product. Samples are representative only and may not match the final product exactly.
7.2 Product Specifications
While we endeavour to ensure product specifications are accurate, specifications may be subject to change. Please confirm critical specifications before ordering.
7.3 Batch Variations
Products from different production batches may exhibit slight variations. For large projects, we recommend ordering from a single batch where possible.
8. Installation
8.1 Installation Responsibility
Installation of Products is the responsibility of the purchaser unless otherwise agreed in writing. Hansen Flooring does not provide installation services directly but can recommend qualified installers.
8.2 Installation Requirements
Products must be installed in accordance with manufacturer guidelines, industry standards, and New Zealand building codes. Failure to follow proper installation procedures may void the product warranty.
8.3 Site Conditions
You are responsible for ensuring the installation site meets all necessary requirements, including subfloor preparation, moisture levels, and acclimatisation of products before installation.
9. Warranty
Products are covered by manufacturer warranties as specified in our Warranty Information. Warranty claims must be made in accordance with the warranty terms and conditions.
Warranties do not cover damage caused by improper installation, misuse, lack of maintenance, or normal wear and tear.
10. Limitation of Liability
10.1 Maximum Liability
To the maximum extent permitted by law, Hansen Flooring’s total liability to you for any claim arising out of or in connection with these Terms or any Contract shall not exceed the total price paid by you for the relevant Products.
10.2 Exclusions
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use our Products.
10.3 Consumer Guarantees Act
Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Consumer Guarantees Act 1993 if you are a Consumer.
11. Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of Hansen Flooring or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use our content without our prior written consent.
12. Force Majeure
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, supply chain disruptions, or government actions.
13. Disputes
13.1 Resolution
We aim to resolve any disputes amicably. If you have a complaint, please contact us in the first instance to discuss a resolution.
13.2 Governing Law
These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
14. General Provisions
14.1 Entire Agreement
These Terms, together with any quotation or order confirmation, constitute the entire agreement between you and Hansen Flooring regarding the purchase of Products.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
14.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after any changes indicates your acceptance of the updated Terms.
